The Diversion Program is an agreement or contract in a criminal case between an offender and the District Attorney’s Office.  In this agreement, the client agrees to perform certain conditions within a specified time.   Not all Diversion/Deferred prosecution agreements are alike and each are individualized to meet the client's needs and or the needs of the victim in the case.  

Examples of common conditions in Diversion Agreements:

  • Letter of Apology
  • Community Service Work
  • Drug and Alcohol Assessment
  • Domestic Violence Assessment
  • Parenting Classes
  • Restitution 

These are just some examples of what may be ordered as a condition of an agreement.  In a Diversion Agreement, criminal prosecution is suspended immediately after you enter a plea of guilty to your charges whereas in a Deferred Prosecution Agreement criminal prosecution is suspended immediately without a plea of guilty upon filing the agreement with the Court.  If a Diversion client is successful their criminal charges may be dismissed or reduced to a misdemeanor or forfeiture. 

Individuals interested in the Diversion Program must attend the Diversion Orientation prior to entering their plea.  Due to Covid-19 all orientations are being done one on one.  They can either be completed in person or by video.  To schedule an orientation please contact our main number (608) 269-8835 or email jbonds@co.monroe.wi.us at least 5 business days in advance.
